Why Give Kids a Chance Act
is Important
NEW COMBINATIONS OF CANCER DRUGS ARE SAVING LIVES OF ADULTS WITH CANCER, BUT THEY ARE NOT SAVING CHILDRENS’ LIVES.
Adults with cancer get trials with combinations of new targeted medicines because combinations maximize the chance of cures. Why then do kids with cancer only get trials with one new drug at a time?
No one new cancer drug will be the magic bullet to cure all patients. That is why there are currently hundreds, perhaps thousands of combinations of targeted cancer medicines being studied in adult cancer trials – because targeted combinations have the best chance of cures.
However, there are only a handful of combination trials for children’s cancers. Pediatric cancer is terrible, but thankfully few children get cancer and companies can’t go into these pediatric cancer markets to study combinations of medicines and achieve a market rate a return.
For kids with cancer who have tried all possible treatments and who are terminally ill, the only choice left is an off-label treatment of a targeted combination – with no information of whether it might be effective or toxic and no information about the dosage -- or no treatment at all.
In 2003, Congress passed the Pediatric Research Equity Act (PREA) establishing the principle that medicines prescribed for children are studied in children. The Give Kids a Chance Act ensures combinations of cancer medicines will be studied in children’s cancers.
What Give Kids a Chance Act Provides
The Give Kids a Chance Act would provide for pediatric investigations of combinations of novel drugs
The Give Kids a Chance Act amends section 505B of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355c), which concerns “research into pediatric uses for drug and biological products”. Specifically, the bill relates to the RACE for Children Act, subsection (a)(1)(B), “certain molecularly targeted cancer indications”. Under that subsection, when an original new drug application (NDA) or biologics license application (BLA) is submitted to FDA for a new active ingredient to treat an adult cancer, the applicant company is required to conduct a pediatric investigation of the drug or biological product if it is directed at a molecular target that FDA determines is “substantially relevant to the growth or progression of a pediatric cancer.” (See Section 504 of the FDA Reauthorization Act of 2017, Pub.L. 115-52. Law 115-52. Aug. 18, 2017).
The Give Kids a Chance Act would not change the provisions of the RACE for Children Act that, in the case of an original NDA/BLA for a new active ingredient, trigger the requirement for a pediatric investigation. Rather, when that requirement is triggered, the Give Kids a Chance Act would give FDA a new option. FDA could instead decide to use the Give Kids a Chance Act’s new option, which would be to require a pediatric investigation of the new single novel cancer drug in combination with another active ingredient. The additional active ingredient would be (1) an active ingredient in a generic or biosimilar drug that is the standard of care for a pediatric cancer, or (2) an active ingredient in an already-approved drug to treat an adult cancer for which the 505B(a)(1)(B) applicant is the sponsor, or (3) an IND drug being studied jointly by that applicant and another company per their agreement.
In addition, the Give Kids a Chance Act would expand the scope of the pediatric-investigation requirement by also requiring a pediatric investigation when (1) an NDA/BLA is submitted for a novel combination of active ingredients to treat an adult cancer, (2) each of those active ingredients has separately been approved to treat an adult cancer, and (3) FDA determines that the molecular target of the novel combination is substantially relevant to the growth or progression of a pediatric cancer. A combination of active ingredients is “novel” if FDA has never before approved an NDA/BLA for that particular combination. The FDA could also waive or defer the pediatric investigation.
Finally, the Give Kids a Chance Act would provide for two pediatric studies by the applicant company.
Enacting the Give Kids a Chance Act would ensure that combination medicines used to treat children with cancer are studied in children with cancer. The Give Kids a Chance Act would lead to more treatments for children with cancer.
Give Kids a Chance Act’s Legislative History
THE GIVE KIDS A CHANCE ACT WAS PASSED BY THE US HOUSE OF REPRESENTATIVES ON A BIPARTISAN, UNANIMOUS BASIS IN 2024 AND 2022 AND WAS INCLUDED IN THE FIRST VERSION OF THE DECEMBER 2024 GOVERNMENT FUNDING BILL.
117th Congress - passes in the House
Give Kids a Chance Act is passed in the House of Representatives as part of the FDA PDUFA bill. It is stripped out of the FDA PDUFA bill in the Senate along with almost all other riders. Sponsors are Representatives Michael McCaul and GK Butterfield and Senators Michael Bennet and Marco Rubio.
118th Congress - passes in the House, included in the first CR
The exact same language of the Give Kids a Chance Act passed in the House in the 117th Congress is introduced in the 118th House and Senate by Representatives Michael Michael and Anna Eshoo and by Senators Michael Bennet and Marco Rubio.
- The Act is passed in the House of Representatives Energy and Commerce Committee as HR 3433 as part of a bigger FDA bill also called the Give Kids a Chance Act. The Act now also includes the Creating Hope Reauthorization Act pediatric priority review voucher program.
This new version of Give Kids a Chance Act, HR 3433, is passed unanimously by the House of Representatives.
The Give Kids a Chance Act introduced in the 117th and 118th House and Senate is included in the health package of the December CR bill to funding the government, HR 10445. The text of the original Give Kids a Chance Act introduced in the 117th and 118th Congress appears in HR 10445 in Division E, Title VII, Subtitle A, Sec. 801.
After tweets by Elon Musk, HR 10455 fails. Congress ultimately passes a third continuing resolution to fund the government that does not include the Give Kids a Chance Act, or the Creating Hope Reauthorization Act pediatric priority review voucher program.
The Senate takes up HR 3433 on a unanimous consent vote. The vote fails based on the objection of Senator Rand Paul.
